Terms & Policies
These Terms & Policies (“Agreement”) govern all products and services provided by Kenyton (“Company”, “we”, or “us”). By engaging with our services, purchasing hardware, or accessing our software platforms, the client (“Customer” or “you”) agrees to be bound by this Agreement.
1. General Terms
- Kenyton reserves the right to update, modify, or amend these policies at any time without prior notice.
- Payment for services indicates acceptance of this Agreement.
2. Website Design Services
- A non-refundable deposit of 50% is required before project commencement.
- Estimated completion time for initial builds is 2–4 weeks after receiving required materials and payments.
- Clients are entitled to three (3) rounds of revisions; further revisions may incur additional fees.
- All modification requests must be submitted in writing.
- Website source code, frameworks, or proprietary assets will not be released due to licensing and intellectual property restrictions.
- Domain transfer assistance is available, with third-party fees payable by the client.
3. Graphic Design Services
- Clients may request up to three (3) revisions after receiving the first draft.
- All changes must be provided in writing.
- Editable or master design files are not included unless specifically purchased.
4. Printing Services
- Once approved, all printed materials are final sale and non-refundable.
- Kenyton is not responsible for errors, inaccuracies, or color variations after client approval.
- Reprints due to client error incur additional charges.
5. Hardware Sales
- All hardware sales are non-refundable, non-returnable, and not exchangeable for cash.
- Hardware includes a one (1) year limited warranty on manufacturer defects only.
- Damage caused by misuse, improper installation, or unauthorized repairs is not covered.
6. Salon Management Software & Online Booking Platform
- Access is provided on a subscription basis; fees are non-refundable once charged.
- Clients must maintain accurate business, staff, and pricing information.
- Temporary service interruptions may occur during scheduled maintenance.
- Software source code, system logic, and database structures remain the intellectual property of Kenyton.
- Accounts may be suspended for non-payment or system misuse.
7. POS System Services
- Setup and onboarding fees are non-refundable once services have commenced.
- Kenyton is not responsible for downtime due to internet failures, third-party gateways, or client hardware issues.
8. Merchant Services (MSP / ISO)
- All merchant accounts are subject to approval by the acquiring bank or MSP partner.
- Kenyton cannot guarantee merchant approval or settlement timelines.
- The client must maintain PCI-DSS compliance and adhere to payment card rules.
- Kenyton is not liable for chargebacks, account freezes, or financial losses arising from merchant disputes.
9. Limitation of Liability
Kenyton shall not be liable for indirect, incidental, or consequential damages including, but not limited to, loss of revenue, business interruption, or data loss. Total liability shall not exceed the amount paid for the service in the preceding three (3) months.
10. Governing Law
This Agreement is governed by the laws of the Province of Alberta, Canada.
11. Acknowledgement
By submitting payment, accessing our platform, or requesting services, the client acknowledges that they have read, understood, and agree to be bound by these Terms & Policies.
